PART III: MOVING FORWARD Part III of this report explores pending legislation and proposed solutions across the immigration system, with a particular focus on those affecting Black immigrants. Additionally, Part III will delve into some ongoing litigation related to DACA and TPS. Lastly, Part III concludes with specific actions the Biden Administration and Congress can take to improve TPS, DED, and LRIF.

Immigration Policies and Legislation on the Horizon With a new presidential administration and a new congress, immigrant communities are demanding that federal lawmakers take immediate action to protect the millions of immigrants who call the United States home and to finally end the cruelty of the current immigration system. UBN, along with immigrant communities across the country, envisions an immigration system that rejects anti-Blackness, xenophobia, and Islamophobia. The immigrant justice movement’s demand for a path to citizenship for all 11 million undocumented immigrants has led to the introduction and passage of some promising pieces of legislation, discussed below. The Dream and Promise Act of 2021 - H.R. 6 The Dream and Promise Act of 2021 (H.R. 6), if enacted, would create a pathway to citizenship for those currently in the DACA, TPS, and DED programs. H.R. 6 was introduced in the House of Representatives by Congresswoman Royball-Allard (D-CA) on March 3, 2021. The Dream and Promise Act of 2021 would offer permanent protection to those currently stuck in temporary DACA, TPS, and DED programs. Although this proposed law is a strong step in the right direction, there remains room for improvement.
