Nielsen USCIS is extending appropriate TPS-related documentation for eligible beneficiaries of TPS for Honduras and Nepal. The termination of TPS for these countries will not take effect while the Ramos appeals continue. 108 Saget v. Trump The District Court for the Eastern District of New York enjoined the termination of TPS for Haiti, and a final decision is pending. In order for TPS beneficiaries from Haiti to keep their status, they must continue to meet specific TPS eligibility requirements. 109 Notably, President Biden’s Secretary of Homeland Security Alejandro Mayorkas announced a new TPS designation for Haiti on May 22, 2021. 110 In its release of this announcement, DHS referenced the unsettled nature of the pending TPS litigation while also indicating that Haitians affected by those decisions were eligible to apply under the new designation. 111
